SocialMatik Terms of Service

Effective date: 13 July 2026. These Terms of Service ("Terms") govern your access to and use of the SocialMatik website and services at https://socialmatik.com (the "Service"), operated by SkafTech ("SocialMatik", "we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. Acceptance of Terms

If you do not agree with these Terms, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. Description of the Service

SocialMatik is a social media management platform that lets you create, schedule, and publish content, generate content with AI, manage media, and connect third-party social media accounts to publish content on your behalf.

3. Eligibility and Accounts

You must be at least 16 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Connected Social Accounts and Third-Party Platforms

When you connect a third-party platform (including TikTok, Meta/Facebook, Instagram, LinkedIn, X, YouTube, and Google), you authorize SocialMatik to access and act on that account solely to provide the features you activate, such as retrieving your profile and publishing content you schedule. You remain responsible for the content you publish and for complying with each platform's terms and policies, including the TikTok Terms of Service, the TikTok Developer Terms, and the TikTok Community Guidelines. We publish or manage content only on your instruction, and you can disconnect any platform at any time, which revokes our access.

5. Acceptable Use

You agree not to use the Service to: (a) violate any law or third-party rights; (b) publish spam, malware, deceptive, hateful, or infringing content; (c) violate the terms or policies of any connected platform; (d) attempt to gain unauthorized access to the Service or interfere with its operation; or (e) misuse AI features to create prohibited content.

6. Your Content

You retain ownership of the content you create or upload. You grant us a limited license to store, process, and transmit your content solely to operate the Service and to publish it to the platforms you choose. You are solely responsible for your content and confirm you have the rights necessary to publish it.

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by SocialMatik and SkafTech and protected by law. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.

8. Subscriptions and Payments

Certain features require a paid plan. Fees, billing cycles, and any AI credit usage are described at purchase. Unless stated otherwise, fees are non-refundable except where required by law. We may change pricing with reasonable notice.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that third-party platforms will remain available or continue to support integrations.

10. Limitation of Liability

To the maximum extent permitted by law, SocialMatik and SkafTech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless SocialMatik and SkafTech from claims arising out of your content, your use of the Service, or your violation of these Terms or any third-party platform's rules.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Upon termination, your right to use the Service ends and connected-platform access is revoked.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-laws rules, and, where applicable, mandatory consumer-protection laws of your country of residence.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the effective date above. Continued use of the Service after changes take effect constitutes acceptance.
